State control and supervision in Kazakhstan has been developing since 1991, when it was adopted The Law "On Protection and Support of Private Entrepreneurship" (1992).
- Article 12, Chapter 2-The registration authority informs the state supervision and control bodies about the registration of an entrepreneur.
- State control and supervision should not interfere with the implementation of private business activities.
- Inspections are possible only within the established competence and with the consent of the entrepreneur, with the exception of cases related to criminal prosecution.
- Seizure and seizure of original accounting and other documents is prohibited (with the exception of a preventive measure for a committed offense or as evidence in a criminal case).
- Withdrawal of documents is allowed only in exceptional cases.
- The Law became invalid due to the adoption of the Law of the Republic of Kazakhstan "On Private Entrepreneurship".
On 31.01.2006, the Law of the Republic of Kazakhstan "On Private Entrepreneurship" was adopted.
New rules of control and supervision have been introduced, as well as a list of authorized bodies.
The law became invalid with the adoption of the law "On State Control and Supervision".
The rights and obligations of both controlling and audited parties were regulated, and procedures and rules for interaction during inspections were defined.
The annex to the law established a list of areas of activity of private business entities that are subject to State control and supervision.
Most of the provisions of the law were later transferred to the Business Code.
29.10.2015 the Business Code was adopted.
Chapter 13 of the Business Code establishes:
- procedure for conducting state control and supervision,
- procedure for interaction of control and supervision bodies during state control and supervision,
- rights and obligations of subjects of state control and supervision,
- measures to protect their rights and legitimate interests,
- rights and obligations of control and supervision bodies and their officials.
The Code also specifies areas in which its rules do not apply or sets exceptions to the general rules, taking into account the specifics of various areas of private entrepreneurship.
Within the framework of the legislation, state control is carried out in various areas of activity, including:
- the tax service
- architecture and construction
- environmental protection
- veterinary medicine
- border control system
- sanitary andepidemiological service
- in the field of labor legislation
- etc.
