Veterinary and sanitary control and supervision in the Republic of Kazakhstan

Veterinary and sanitary control and supervision in the Republic of Kazakhstan are aimed at ensuring the protection of animal and human health, preventing the spread of infectious diseases, as well as compliance with veterinary requirements in various fields of activity. This overview includes key regulatory aspects, sources of legal norms, and practical tools that will be useful:

  • Organizations engaged in the production, processing, storage, and sale of animal products.
  • Entrepreneurs who work in the field of veterinary medicine or use objects of veterinary supervision.
  • Government agencies and their representatives responsible for compliance with the law.

Knowledge of current requirements will help minimize the risks of inspections, effectively respond to regulatory requirements, and maintain compliance with veterinary standards.

This article is based on the following regulatory acts regulating veterinary and sanitary control:

  1. The Law of the Republic of Kazakhstan "On Veterinary Medicine";
  2. Business Code of the Republic of Kazakhstan;
  3. Law of the Republic of Kazakhstan "On Biological Safety of the Republic of Kazakhstan";
  4. Order of the Minister of Agriculture of the Republic of Kazakhstan dated 30.10.2014 No. 7-1 / 559 "On approval of regulatory legal acts in the field of veterinary medicine";
  5. Joint Order of the Minister of Agriculture of the Republic of Kazakhstan dated 25.12.2015 No. 7-1 / 1130 and the Minister of National Economy of the Republic of Kazakhstan dated 28.12.2015 No. 802 "On approval of risk assessment criteria and test sheets in the field of veterinary medicine";
  6. Order of the Acting Minister of Agriculture of the Republic of Kazakhstan dated 28.06.2024 No. 231 "On approval of the Rules for conducting an investigation in the field of veterinary medicine".

State veterinary and sanitary control is carried out by state veterinary and sanitary inspectors in the form of inspection, preventive control without visiting / with visiting the subject (object) of control and investigation:

1) at production facilities engaged in raising animals, harvesting (slaughtering), storing, processing and selling animals, products and raw materials of animal origin, as well as in organizations for the production, storage and sale of veterinary drugs, feed and feed additives;

2) at domestic trade facilities;

3) persons engaged in entrepreneurial activities in the field of veterinary medicine, including licensed ones;

4) in state veterinary organizations;

5) at veterinary control posts;

6) during transportation( moving), loading, unloading of objects being moved (transported);

7) on all types of vehicles, on all types of containers, packaging materials that may be factors in the transmission of pathogens of animal diseases;

8) on cattle-driving routes, routes, territories of pastures and watering places of animals, along which transportation (movement) routes pass;

9) on the territories, in industrial premises and behind the activities of individuals and legal entities that grow, store, process, sell or use movable (transported) objects, as well as carry out activities in the field of veterinary medicine;

10) control over compliance with zoohygienic and veterinary (veterinary and sanitary) requirements during the placement, construction, reconstruction and commissioning of animal burial grounds (biothermal pits), objects of state veterinary and sanitary control and supervision related to the maintenance, breeding, use, production, harvesting (slaughter), storage, processing and sale, and also when transporting (moving) objects that are being moved (transported).

11) monitoring the performance of functions of local executive bodies and their subdivisions that carry out activities in the field of veterinary medicine.

Preventive control without visiting the subject (object) of control and supervision is carried out by analyzing and comparing data and information:

1) from information systems;

2) from veterinary accounting and reporting;

3) notifications and notifications of authorized bodies of other states;

4) received from organizations that are part of the veterinary medicine system;

5) from open sources, mass media.

Inspection and preventive control with a visit to the subject (object) of control and supervision are carried out in accordance with the Business Code of the Republic of Kazakhstan.

Preventive control without visiting the subject (object) of control and supervision is carried out in accordance with the Business Code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "On Veterinary Medicine".

The investigation is conducted in accordance with the Business Code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "On Veterinary Medicine". The decision to conduct an investigation is made by the head of the territorial division of the department of the authorized body of the corresponding administrative-territorial unit.

See Order No. 231 of the Acting Minister of Agriculture of the Republic of Kazakhstan dated 28.06.2024 "On approval of the Rules for conducting an investigation in the field of veterinary medicine".

Based on the results of state control, when violations are detected by state veterinary and sanitary inspectors, an act of supervision is issued and the following rapid response measures are applied:

1) prohibition of import, export, transit, transportation( movement), production, use and sale of moved (transported) objects, return of moved (transported) objects that do not meet the requirements of the legislation of the Republic of Kazakhstan in the field of veterinary medicine, international treaties of the Republic of Kazakhstan and acts constituting the law of the EAEU;

2) suspension, withdrawal (revocation), termination of the validity of a permit document in the field of veterinary medicine;

3) prohibition or suspension of activities or certain types of activities in accordance with the laws of the Republic of Kazakhstan;

4) removal and destruction of animals, products and raw materials of animal origin that pose a danger to animal and human health;

5) stopping the vehicle and detaining objects being moved (transported).

The subject of control and supervision is obliged to eliminate the identified violations of the requirements that are the basis for applying a rapid response measure, within the time limits specified in the investigation report, as well as in the order to eliminate the identified violations.

If the identified violations of the requirements that are the basis for applying a rapid response measure are not eliminated, measures are taken to bring the persons who committed violations to justice.

In case of disagreement with the results of state control that led to the application of rapid response measures, the subject of control and supervision may file a complaint about the recognition of the act of supervision as invalid and its cancellation.

State control and supervision is carried out in relation to the subject, depending on the scope of its activities.

Joint Order of the Minister of Agriculture of the Republic of Kazakhstan No. 7-1/1130 dated December 25, 2015 and the Minister of National Economy of the Republic of Kazakhstan No. 802 dated December 28, 2015 approved veterinary inspection sheets, according to which the subject can check the compliance of the enterprise with the requirements of the legislation in the field of veterinary medicine.
